1. Acceptance of Terms

By accessing or using the Unified Tender Solutions website at https://unifiedtenders.com (the “Website”), you agree to comply with and be bound by these Terms of Use (the “Terms”). If you do not agree with any part of these Terms, you must not use the Website.

2. Changes to Terms

Unified Tender Solutions reserves the right to modify these Terms at any time. Updates will be posted on this page with a revised effective date. Your continued use of the Website following such changes constitutes your acceptance of the updated Terms.

3. Use of the Website

3.1 Restrictions

You agree not to:

  • Use the Website for any illegal or unauthorized purpose.

  • Redistribute, republish, or transmit any information obtained from the Website to third parties, including but not limited to commercial enterprises, large-scale operations, or social media and messaging platforms such as WhatsApp groups.

  • Use the Website in any manner that could damage, disable, overburden, or impair the Website or interfere with any other party’s use of the Website.

3.2 Accuracy of Information

While we strive to provide accurate and up-to-date tender information, we make no warranties regarding the accuracy, completeness, or timeliness of the information provided. Users are responsible for verifying tender details directly with the procuring agency.

4. Content Ownership

All content and materials on the Website, including text, graphics, logos, and software, are the property of Unified Tender Solutions or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.

5. Publishing Timelines

We aim to publish tender details within 3 business days of receiving the information from the procuring agency. However, we are not responsible for any delays, omissions, or inaccuracies in the published details.

6. Subscription and Payment

6.1 Subscriptions and Payment Model

  • Access to certain features and services on the Website requires a paid subscription.

  • All subscriptions are recurring in nature, requiring timely renewal before expiry to maintain uninterrupted access.

  • We currently accept payments via:

    • Bank transfer (EFT)

    • Approved mobile payment methods

    • Credit and debit cards (Visa, MasterCard, and others) processed securely through our payment partner, DPO.

  • Unified Tender Solutions is in the process of implementing a fully automated online billing and payment system. Once introduced, all subscribers will be required to migrate to the automated billing system for all future payments and renewals.

  • Clients with internal procurement or payment policies that require alternative processes may apply, in writing, for special arrangements. These exceptions will only be granted upon prior written agreement and may be subject to additional terms and conditions.

  • All cancellations must be requested at least 7 (seven) calendar days before the next billing period begins.

  • Clients remain liable for all invoices generated prior to a valid cancellation request, including any outstanding payments if the account is suspended or terminated due to non-payment.

6.2 Refund Policy

  • All activated subscriptions are non-refundable.

  • Refunds will not be issued for unused subscription periods or in cases where services are suspended or terminated due to non-payment or breach of these Terms.

  • Clients remain responsible for settling any outstanding invoices, regardless of service suspension or cancellation.

7. Limitation of Liability

To the fullest extent permitted by law, Unified Tender Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Website or services.
Our total liability shall be limited to the subscription or service fee paid by you that gave rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Unified Tender Solutions, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising from your use of the Website or your violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Namibia, without regard to its conflict of law provisions.
Any legal action arising under these Terms shall be brought exclusively in the courts of Namibia.

10. Termination

We reserve the right to terminate or suspend your access to the Website, without prior notice, for any reason, including but not limited to violations of these Terms.
